Wills Protect What Matters Most
If you choose not to construct a will, then who concludes who acquires what? Often it may not go the way you would have chosen. To make sure your wishes are followed, you need to build a last will and testament.
Should you pass away without making a will it’s the law that decides how your estate is divided. The intestacy rules will be used and it will not be how you’d have hoped or wanted.
If you are legally married or have a civil partner but no offspring and your assets is valued at a specific figure or under then your partner would get the total of the assets including any life assurance . If the assets is worth greater than this figure and you have surviving relatives, your spouse would still receive this figure, in addition to half of the excess. There exists an order in which family would inherit, with surviving parents positioned at the top of the list, followed by siblings and so on.
If you have a spouse and offspring then your spouse would receive the specific amount as above and 50% of the excess. The offspring will receive half of the amount over the set amount right away and the other half on the passing of your spouse.
Should you have children but no legal partner, then your offspring would divide the estate. This might not be as you’d have hoped. You could have a companion who relies on you and who you might have intended to inherit at least a proportion of your estate, who would receive nothing.
To remove all possible apprehension about your assets, however straightforward it may seem, it would be wise to draw up a last will and testament. There are various ways to do this. You could build it on your own or hire a trained will writer or a solicitor.
Often people write their own last will and testament, commonly using a template which can buy from the post office. Caution is advised if you go along this route – it’s very simple to make a mistake and you could potentially find it void. The price of having a will constructed, especially a comparatively straightforward one, is not prohibitive and you can be confident that your wishes will be realised.
A professional will service or a solicitor will be used to processing all forms of queries and will be able to assist you. You might have questions about setting up trust funds and perhaps inheritance tax.
Having drawn up your will, it’s a sensible decision to review it periodically, as your situation changes. If you decide to amend it, then it is a smart move to nullify your existing one and have it re-written. If the alterations are minor, it might be more straight forward to draw up a codicil to make a section of the last will and testament and to be read in partnership with it. Any codicil will have to be written in the same way as the will in relevance signatures and witnesses.
Please be aware that any medical insurance cover will terminate on the death of the will holder and no value will be attributed to It in the will.
